Since the TN status is conferable in one year increments, with no outside limit on the total period of stay, it may be extended using the I-129 form. Family members of the TN alien, who are present in the U.S. in the TD category, must file simultaneous extension requests. This can be done either by mail or at the border.

The extension must be filed by:

  • A U.S. Employer of the Canadian TN professional, or
  • A U.S. entity which has a contract with the Canadian employer of the TN professional providing for the rendering of professional services, or
  • A U.S. entity which has a contract with a self-employed Cnadian rofessional providing for the rendering of professional services

The professional cannot be rendering services to a corporation or entity of which the professional is the sole or controlling shareholder or owner. The USCIS reasons that the alien, in that case, would be seeking admission for the purpose of establishing a business.

Legislation enacted in 2000 creates a premium processing adjudication program. Under the program, business petitioners may choose to pay a fee to obtain expedited processing of their cases. Such cases must be adjudicated within fifteen business days. TN extension requests filed on Form I-129 are eligible for expedited processing.
